Terms and Conditions

1. Order Process (Law 31-08 Art. 14)

• Product details, prices (MAD), and shipping costs are displayed before checkout.
• Order confirmation email = contract acceptance (unless cancelled).
• We reserve the right to refuse orders (stock out, fraud risk, non-compliance).

2. Pricing & Cash on Delivery (Law 53-05)

• COD only: Pay the courier (Aramex / Maroc Poste / CMRT) upon delivery.
• Prices exclude shipping/taxes; final amount confirmed at delivery.
• No advance payments or credit cards.

3. Delivery Times (Law 31-08 Art. 24)

• Morocco: 3–10 business days from order acceptance.
• Delays due to customs, strikes, or force majeure = no liability.
• Track via courier SMS. Inspect goods on receipt — damage claims must be directed to the carrier.

4. Right of Withdrawal (Law 31-08 Art. 21)

• 14-day cooling-off period from delivery receipt for unused items in original packaging.
• Return shipping at your cost (except defective items).
• No withdrawal: Digital products post-download, custom goods, hygiene-sealed items.
• Refunds within 30 days of return receipt (excluding restocking fee of 10–20%).

5. Warranties (Law 31-08 Art. 28-34)

• Legal warranty against hidden defects: 2 years (movable goods).
• Manufacturer warranties (e.g., Moza = 2 years) honored via us.
• Return defective items within the warranty period.

6. Digital Products

• Licenses: Download link provided post-COD confirmation.
• No refund once accessed (nature of digital goods).

7. Liability Limits (Law 31-08 Art. 15)

• Liability capped at order value.
• No responsibility for indirect damages, improper use, or compatibility issues.
• Gear used at your own risk.

8. Returns Procedure

• Email support@simworx.ma within 14 days with order #, defect photos.
• Return prepaid to our pickup point within 7 days of approval.
• Refund issued post-inspection (14 days).

9. Force Majeure (Civil Code Art. 1147-1148)

Delays or cancellations are excused for uncontrollable events (natural disasters, pandemics, government actions, etc.).

10. Governing Law & Disputes

• Exclusive Moroccan law applies.
• Disputes: Casablanca commercial courts (or mediation via DGCCRF).
• Consumer: May contact ONSC (Office National de la Sécurité des Consommateurs).

11. Intellectual Property

All site content is the property of Simworx Racing Simulators. No reproduction without written consent.

12. Account Termination

Abuse or fraud = account suspension without notice.

13. Modifications

Terms updates will be notified by email and/or site notice.
